TYKO Capital (“TYKO”) is a multi-billion-dollar Commercial Real Estate Private Equity and Private Credit Investment Management Platform, which is a joint venture between Adi Chugh & a Florida based hedge fund. Acceptance of Terms of Use

These Terms of Use (“Terms of Use” or “Agreement”) state the terms and conditions under which you (“you” or “your“) may use the website located at www.tykocapital.com (the “Site“) and all Content and Services (as defined below) offered through the Site. The Site is owned and operated by TYKO Capital. (“TYKO“, “we“, “our“, or “us“) Please read this Agreement carefully. This Agreement, along with the TYKO Private Policy, govern your use of the Site. If you do not agree with the terms and conditions outlined in this Agreement, you are not granted permission to access or otherwise use the Site. Any use of the Site in a manner inconsistent with these Terms of Use is deemed unauthorized access and may be subject to civil or criminal penalties. This Site contains various information in the form of data, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software, news, reports, videos and other materials relating to TYKO as well as third party content, (collectively, the “Content”). By accessing, browsing and/or using this Site and any services that may be made available through the Site (the “Services”) you acknowledge that you have read, understood and agree to be legally bound by this Agreement. We reserve the right to amend this Agreement at any time and from time to time. If you use the Site after the amended Agreement has been posted, you will be deemed to have agreed to the amended Agreement.

Limited Right to Use

TYKO grants you a limited right to use the Site. Your right to use the Site is subject to your agreement to abide by these Terms of Use in their entirety, as well as any other rules, procedures, policies, terms or conditions that govern all or any portion of the Site. At any time and for any reason TYKO may revoke your right to use all or any portion of the Site.

Use Restrictions

You are expressly prohibited from (i) using any robot, spider, intelligent agent, other automatic device, or manual process to monitor, “mine”, manipulate or copy the web pages on the Site, (ii) using any device, software or routine to interfere or attempt to interfere with the proper working or circumvent, disable or otherwise compromise any security features of the Site, (iii) knowingly or recklessly uploading or transmitting to the Site any data or material that contains viruses, spyware, worms or other malicious software code designed to adversely affect the operation of the Site or TYKO’s software, hardware or networks (iv) taking any action, including flooding, spamming, mailbombing and crashing, that imposes an unreasonable or disproportionately large load on TYKO’s infrastructure, (v) transmitting to the site or to any TYKO personnel, any profane, defamatory, libellous, threatening, obscene or unlawful material, (vi) reverse engineering, decompiling or disassembling the underlying software, (vii) removing any notices, warnings, labels, annotations or instructions from any portion of the Site or any related material, including, without limitation, any trademark, copyright, or other proprietary notices or license provisions, or (viii) otherwise invading the privacy of, obtaining the identity of, or obtaining any personal data about any user of the Site.

TYKO prohibits the use of any links to the Site from any other websites unless establishment of such a link is approved in advance by TYKO in writing. You may not frame any elements of the Site with any other website.

Any violations of system or network security, including attempts to intentionally access a computer without authorization or exceed your authorized access level, may result in civil and criminal charges. TYKO may investigate occurrences that might involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. We may, without prior notice or warning of any kind, restrict or terminate the access of any and all users to the Site if we reasonably conclude that such restriction or termination is necessary to prevent, or prevent the further spread, of a virus, security breach or system malfunction.

User Information

All User Information will be considered NON-CONFIDENTIAL and NON-PROPRIETARY. To accept a subscription for an investment and delivering the services or products under a contract with you or your organization;
Financial management and administration, executing transactions, managing payments, fees and charges and collecting and recovering debts owed to us;
General administration of your or your organizations’ investment or other business relationship with us, including communicating with investors, service providers and counterparties, accounting and auditing accounts, risk monitoring, keeping internal records, notifying you about changes to our terms of business or this Privacy Policy;
Engaging vendors, service providers and suppliers and performing relevant contracts;
Interacting with governmental or regulatory bodies or other competent authorities;

For Marketing and Communication Purposes

We may collect and share your Personal Data with our affiliates for direct marketing purposes, such as informing you electronically or by paper about investment opportunities, offers of products and services to you by us or our affiliates, inviting you to participate in surveys and providing you with other news about TYKO (“Marketing Purposes”) unless and until you notify us that you do not wish to be contacted for Marketing Purposes. If you or your organization are a new investor, we will begin sharing your Personal Data with our affiliates for Marketing Purposes 30 days from the date of the initial investment in or commitment to a fund. When you or your organization are no longerour investor, we may continue to share your Personal Data with our affiliates for Marketing Purposes, unless you elect to unsubscribe from any such communications.

You may opt out of TYKO’s direct marketing at any time by clicking the opt-out links in any electronic marketing communication we send to you or by using the contact details in the “Contact and Complaints” section below.

Unless we inform you that the provision of your Personal Data is optional, any Personal Data we request is necessary for us to provide you or your organization with the products and services requested. If you do not provide the Personal Data requested, we may not be able to provide those products and services.

Serena Hernandez is the Chief of Staff and Office Manager of TYKO Capital. She is responsible for working closely with the CEO regarding business development and strategic planning. She leads special projects and initiatives for the team and aims to deliver a high client experience. Serena also manages all office administration and arrangements for the company.

Prior to joining TYKO, Serena was part of a wealth management team at Morgan Stanley Global Headquarters for over four years. While serving as a Client Service Associate, her focuses were on philanthropy, sports and entertainment, and ultra-high net worth individuals. She collaborated closely with the advisors in strategic planning, supporting the management of the business opportunities, and worked to implement strategies and best practices.

Serena graduated from Cornell University, with a Bachelor of Science in Human Development and a minor in Education. She received a Certificate of Business of Entertainment from Columbia Business School and Certificate in Diversity and Inclusion from Cornell University.

Prior to joining TYKO, Christian was a Vice President in Deutsche Bank’s Real Estate Special Situations Group, a principal debt investment group focused on investing the bank’s balance sheet capital in the real estate credit sector. From 2013 to 2020, Christian was responsible for sourcing, structuring, and executing high-yield real estate loans.

Christian began his career as an investment banking analyst at Houlihan Lokey and as a financial analyst at Magnus Capital Partners, a U.S. based private real estate investment firm that focuses on value-add strategies.

Christian graduated from The Wharton School at the University of Pennsylvania with a Bachelor of Science in Economics, with concentrations in finance and real estate.

Adi Chugh

Founder & CEO

Adi Chugh is the Founder & CEO of TYKO Capital, which is a Commercial Real Estate Investment Management Platform headquartered in New York and is a Joint Venture between Adi Chugh and Elliott Investment Management.

Adi was previously the Founder and CEO of Surya Capital Partners, a nationwide CRE private equity and debt advisory firm. He brings extensive experience from working on Wall Street across various sectors and across the balance sheet. He founded Surya Capital Partners at the end of 2010 as he identified an opportunity in the distressed real estate space. Since then, he has built a network that includes relationships across the lending and equity world – including top private equity firms, large institutional investors, and real estate sponsors. He has arranged over $40+ billion dollars in transactions since inception, including traditional debt products, joint ventures, Co-GP investments and other capital stack arrangements.

Adi began his career as an Investment Banker with Wachovia Securities in their Leverage Finance Group in March 2004. He then moved onto the Equity Capital Markets Group in New York, and he placed approximately $16 billion of financings in his time at Wachovia. From there, Adi moved onto becoming Vice President for Kotak Mahindra; one of the largest Indian investment banks. He also worked for Merrill Lynch in New York.

Adi grew up in New Delhi, India and moved to the states to attend college. Adi then attended Dickinson College in Carlisle, PA and graduated with a degree in Economics and International Business & Management. He has been an avid public speaker and debater, speaking at events globally. He is also a die-hard fan of the Indian Cricket team. Adi is involved with major charities focusing on underprivileged children and providing needs to the community – namely Children’s Hope India and the Met Council amongst others.
